1. General provisions

This Acceptable Use Policy (hereinafter — the "Policy") establishes the rules for using the MulenPay services provided by RBY Commerce Ltd. (hereinafter — the "Company", "MulenPay").

The purpose of this Policy is to ensure the safe, lawful and good-faith use of the Company services by all users, merchants and partners.

Use of the MulenPay services means full acceptance of this Policy.

2. Scope of application

This Policy applies to:

  • users of the website;
  • merchants;
  • clients;
  • partners;
  • representatives of legal entities;
  • persons using the API, software and other services of the Company.

3. Lawful use

Users are obliged to use the Company services exclusively for lawful purposes and in accordance with:

  • applicable law;
  • the terms of the User Agreement;
  • the Merchant Agreement;
  • the AML/KYC Policy;
  • the Sanctions Policy;
  • other internal documents of the Company.

4. Prohibited activities

It is prohibited to use the MulenPay services for activities related to:

Unlawful activity

  • violation of the law;
  • fraud;
  • legalisation (laundering) of proceeds obtained by criminal means;
  • financing of terrorism;
  • financing of unlawful activity;
  • circumvention of international sanctions.

Financial crimes

  • forgery of documents;
  • theft of personal data;
  • unauthorised use of payment instruments;
  • fraudulent payments;
  • schemes for the return of funds without grounds.

Malicious activity

  • distribution of viruses;
  • malicious software;
  • phishing;
  • hacking of systems;
  • DDoS attacks;
  • unauthorised access to data.

Infringement of the rights of third parties

  • infringement of copyright;
  • infringement of trademarks;
  • unlawful use of intellectual property;
  • disclosure of confidential information.

5. Restricted categories of activity

The Company has the right to refuse service or to restrict the provision of services to organisations related to:

  • financial pyramids;
  • fraudulent investment programmes;
  • unlicensed financial services;
  • unlicensed gambling;
  • activity related to the circumvention of sanctions;
  • the sale of counterfeit products;
  • the sale of prohibited goods and services;
  • activity that creates excessive legal or reputational risks.

The Company independently determines the admissibility of a particular category of business.

6. Account security

The User is obliged to:

  • ensure the confidentiality of the account credentials;
  • use strong passwords;
  • immediately notify the Company of any suspected compromise of the account;
  • not grant access to the User account to third parties.

All actions carried out through the User account are deemed to have been carried out by the User until the moment the Company is notified of the compromise of access.

7. Use of the API and software

When using the API and technical services of MulenPay, it is prohibited to:

  • interfere with the operation of the Company infrastructure;
  • attempt to circumvent security restrictions;
  • use automated means to attack the system;
  • create an excessive load on the services;
  • gain access to the data of other users.

The Company has the right to limit the number of requests to the API and to apply technical means of protection.

8. Control and monitoring

The Company has the right to monitor the use of the services in order to:

  • detect violations;
  • prevent fraud;
  • comply with AML/KYC requirements;
  • comply with sanctions requirements;
  • ensure information security.

Monitoring is carried out to the extent necessary to protect the legitimate interests of the Company and the users.

9. Consequences of violation of the policy

In the event of a violation of this Policy, the Company has the right, without prior notice, to:

  • restrict access to the services;
  • temporarily block the account;
  • request additional information;
  • suspend service;
  • terminate cooperation;
  • report violations to the competent authorities in the cases provided for by law.

10. Limitation of liability

The Company is not liable for consequences arising as a result of:

  • a violation by the User of this Policy;
  • unlawful activity of the User;
  • the actions of third parties;
  • the provision by the User of inaccurate information.

The User is solely responsible for compliance with the law and for the lawfulness of the User activity.

11. Amendment of the policy

The Company reserves the right to amend this Policy at any time.

The new version takes effect from the moment of its publication on the Website.

Continued use of the services after the publication of changes means the consent of the User to the new version of the Policy.
